Vape Industry Bills Under Consideration in Massachusetts

Several bills that could affect the Massachusett’s vape industry will be heard by the Joint Committee on Public Health on Tuesday, July 14th. Some of the bills are standard, such as HB 3466 which bans the sale of vape products to minors, but others may have a profound effect on vape businesses operating within the state.

HB 2021 defines electronic cigarettes as tobacco products, thus making retailers and manufacturers subject to the same rules, licensing fees and fines for non-compliance. SB 1194 allows the Department of Public Health to develop rules and restrictions on the marketing and labeling of vape products.

Perhaps the most onerous bill being presented is HB 3469, which requires all e-liquid manufacturers to file reports with the Department of Public health showing the concentrations of any and all toxins within the vapor produced by an e-cigarette. If the manufacturer is found to have underestimated the amount, there is a $10,000 fine.
